These terms and who we are
These terms apply when you buy a Sovereign Phone and the DatSov Secure Service that comes with it. DatSov is a trading name of ProSolve Ltd. ProSolve Ltd is registered in England & Wales under company number 13955695, registered office 483 Green Lanes, London, England, N13 4BS. This is version datsov-tos-2026-08-01.
Your contract is made up of these terms, our Acceptable Use Policy, and our Privacy Policy. Where these terms and our general Terms of Service conflict, these terms take precedence for a device purchase.
If you are buying as a consumer rather than for a business, you have legal rights that these terms cannot reduce. Nothing here affects them.
How a device is sold, and why it takes longer than a shop
We do not sell these devices from a public checkout. Because of what they are, we verify who we are supplying before we take any money. The sequence is:
- You request a device. Nothing is charged and no contract exists at this point.
- You complete an identity check with our verification provider.
- A named reviewer at DatSov screens the request and decides whether we can supply you.
- If we approve, we send you a single-use payment link for the edition you asked for.
- You pay. We then build, harden and provision your device individually.
- We confirm dispatch. That is the point at which your contract with us is made.
Approval is not acceptance of your order. Sending you a payment link is an invitation to pay, not a promise to supply. We may still decline to proceed after payment — for example if something material comes to light between payment and dispatch — in which case we will refund you in full and the contract will simply never have come into existence.
We may decline any request, and we are not always able to explain why. A decision to decline is not an accusation and does not imply anything about you.
Verification and screening
Completing identity verification and screening is a condition of supply. You agree to give accurate information and to complete the checks. If you decline the biometric element of the identity check, contact us and we will agree an alternative way to establish your identity — declining does not by itself end your request.
What we collect and why is set out in our Privacy Policy. Your identity document is held by our verification provider, not by us.
Price and payment
The price shown for your edition is the amount payable. ProSolve Ltd is not currently registered for VAT, so no VAT is added at checkout. If that changes we will say so clearly before you pay.
The one-time price includes the device, its hardened build and configuration, setup, and the first twelve months of the DatSov Secure Service. Payment is taken by our payment provider; we never see or store your card details.
Prices may be displayed in pounds, dollars or euros depending on where you are. You are charged in the currency you were shown.
Building and delivering your device
Each device is built, hardened and provisioned for you individually. It is not taken off a shelf. Our current lead time is approximately 10 working days from payment to dispatch, and we will tell you if anything is likely to take longer.
Every deployment includes a configuration consultation with your assigned Technical Lead. We will arrange this with you around handover.
Risk in the device passes to you on delivery. Where you have asked us to deliver to a specific address, delivery happens when the device arrives there.
The DatSov Secure Service
Your first twelve months of service are included in the price you pay for the device. After that, the service continues at the monthly rate published for your edition, charged to the payment method you used, until you tell us to stop.
You can end the monthly service by giving us 30 days' notice at any time after the first year. Ending the service does not affect the device you own: it stays yours and keeps working. What stops is our management, updates and support.
The first twelve months are bundled into the device price rather than sold separately, so no part of it is refundable if you stop using the service during that period.
Your right to cancel
If you are a consumer buying at a distance, you normally have 14 days to change your mind. That right does not apply to goods that are made to your specifications or are clearly personalised.
Each Sovereign Phone is built for you individually. The handset is flashed with a hardened operating system build, relocked, and provisioned with an identity created for you and issued only after you have been verified. It is not a stock item and cannot be returned to stock or sold to anyone else. On that basis we treat these devices as made to your specifications, and the 14-day cancellation right does not apply once we have begun building your device.
You can cancel free of charge at any point before we begin building. In practice that means from payment until we confirm that build has started, which is normally within two working days. Contact us at contact@datsov.co.uk and we will refund you in full.
None of this affects your rights if something is faulty, misdescribed, or not as we said it would be — see the next section.
If something is wrong with your device
Your legal rights as a consumer are unaffected by anything in these terms. Goods we supply must be of satisfactory quality, fit for purpose, and as described. If they are not, you are entitled to a repair, replacement or refund depending on the circumstances, and we will not ask you to prove a fault existed at delivery within the first six months.
On top of those rights, we warrant our own work — the hardened build, the configuration, and the provisioning — for 12 months from delivery. If our build is at fault we will put it right at no cost to you. Any manufacturer warranty on the handset itself is separate and additional.
Tell us as soon as you can if something is wrong, at contact@datsov.co.uk or +44 330 321 3113. We would rather hear early.
What we ask of you
Our Acceptable Use Policy sets out the conditions on which we supply, and it forms part of this contract. In short: lawful use only, do not supply a device to anyone you believe intends to use it unlawfully, keep the device under your control, and tell us if it is lost, stolen or seized.
We may suspend or end the service, and decline to supply you further, if we reasonably believe you have breached that policy, gave us false information to obtain a device, or that continuing to supply you would put us in breach of the law. Where it is lawful and appropriate we will tell you first and give you a chance to respond.
Suspension stops our management, updates and support and ends recurring billing. It does not disable your device, and we cannot remotely access, unlock or wipe it.
Our responsibility to you
We do not exclude or limit our liability where the law does not allow it. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your statutory rights in respect of the goods we supply.
Subject to that, we are responsible for loss you suffer that is a foreseeable result of us breaking this contract or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable.
We are honest about what this product can and cannot do, and it matters here. A hardened device reduces risk; it does not eliminate it. We name the two risks we cannot engineer away — the hardware supply chain, and physical coercion of the person holding the device. We do not warrant that any device or service is proof against every attacker, and we do not accept responsibility for loss arising from those residual risks, from your own handling of the device, or from your use of it in breach of the Acceptable Use Policy.
If you are buying for business purposes rather than as a consumer, our total liability is limited to the amount you paid for the device and service in question, and we are not liable for loss of profit, loss of business, business interruption, or loss of anticipated savings.
Changes to these terms
We may change these terms for future purchases. The version that applies to you is the version in force when your contract was made, and it is recorded against your file. We will not change the terms of a purchase you have already made.
Complaints, governing law and disputes
If you are unhappy with anything, please contact us first at contact@datsov.co.uk — most things are resolved quickly that way. We aim to acknowledge a complaint within five working days.
These terms are governed by the law of England & Wales, and you and we both agree that the courts of England & Wales have jurisdiction. If you live elsewhere in the United Kingdom you may also bring proceedings in your own courts, and nothing here takes away any protection you have under the law of the country you live in.
